Wellington murder defendant Spencer Weikal will be prosecuted by an attorney from the office of the Kansas Attorney General, according to court filings made last week.
Asst. Attorney General Lee Davidson will take over the case for Sumner County Attorney Evan Watson. The matter will be back in court at 9 a.m. Thursday so that a new trial date can be set.
The defendant also will have new representation in court. Kansas City attorney Christopher R. Williams filed an entry of appearance Nov. 5 to become the attorney of record for Weikal in this case.
Weikal previously was represented in court by Elaine Esparza.
Weikal is charged with first degree murder, abuse of a child and aggravated endangering of a child in the death of two-year-old Larrissa Foster.
He has pleaded not guilty to the charges.
Prosecutors previously said they also would pursue an alternative charge of unintentional, but reckless second-degree murder.
Foster suffered head injuries Nov. 29, 2011 at a home in Wellington and was taken to a local hospital.
She was later transferred to a Wichita hospital and on Dec. 1, died there.
Medical staff suspected child abuse in the case and alerted authorities, which prompted an investigation.
A trial in the case had been scheduled for last week, until a delay was granted.
