An Ark City man is in jail following an incident Sunday in which he is accused of sexually assaulting a female acquaintance.
Richard Smyer, 32, was booked into jail and could face charges for domestic battery, theft, rape, possession of meth, possession of drug paraphernalia and possession of a controlled substance. He remained in jail late Monday with bond set at $24,250.
Around noon, police were called to a residence in the 400 block of North C for the report of a disturbance. Smyer told police he had been in a minor altercation with an ex-girlfriend with whom he had children.
After the altercation, Smyer said the woman accused him of stealing money.
The woman told police she had asked to stay the night with Smyer and that the two had a brief argument about a debt owed by Smyer.
The woman, who was not identified by name in a written statement regarding the incident, said she later fell asleep at Smyer’s house and eventually woke up feeling as though she had been drugged. She was missing money and suspected she might have been sexually assaulted.
When she demanded her money back, Smyer is accused of attacking the woman and choking her to the point she lost consciousness. She told police she woke up gasping and wheezing on the floor.
The woman left the residence and called a friend for a ride.
Smyer was taken into custody without incident. During questioning, he was found to be in possession of items that may lead to drug charges and had money on him that police suspect belonged to the woman involved in the case.
Officers later conducted a search warrant at Smyer’s residence and seized additional evidence in the case.
