Rogers: Burden chief likely to enter diversion

Embattled Burden police chief Travis Lowe has tentatively reached a diversion agreement in connection with a domestic incident for which he was arrested last fall, his attorney, Chris Rogers, told NewsCow.

Rogers and Cowley County attorney Chris Smith advised the court Monday afternoon that an agreement had been made. Judge Nick St. Peter gave attorneys until April 20 to finalize and sign the agreement and file it with the court.

Lowe was in a Winfield courtroom for just a few minutes Monday afternoon as both sides discussed the matter.

Smith declined to comment on any specifics until a formal document has been signed and submitted to the court.

Rogers would only say that Lowe was likely to take a diversion agreement, though he would not say to what charge. Lowe was originally charged with a misdemeanor count of domestic battery.

Neither side would comment as to how the agreement would affect Lowe’s future as Burden chief.

Through a diversion program, defendants are given a fixed time in which they must complete certain requirements of the agreement and avoid further run-ins with the law. If that can be accomplished, the charge does not become part of the person’s criminal record.

Lowe was arrested Nov. 21 after a domestic incident involving his wife, Lorri Lowe. He is said to have made physical contact with the woman during an argument.

He has been suspended without pay by the city of Burden, pending the outcome of the case against him.
