No appeal is filed; Pit bull is to be destroyed

Barring a last-minute court action, the black, male pit bull Seven will be humanely destroyed as early as next week, a city official said Wednesday.

Seven, and a female pit bull, got free from their pen and entered a Winfield home this past spring where Seven attacked and killed a small poodle. Two judges have heard the case, ruled the dog vicious and ordered it put down.

The dog’s owner, Aaron Cole, originally planned to file an appeal of the latest ruling, made by Judge Jim Pringle in September.

However, Bill Muret, legal counsel for the city, said neither Cole, nor anyone representing him, had filed the case with the Kansas Court of Appeals. Defendants are allowed a certain amount of time to do so, and that time has run out.

Muret plans to consult Cowley County Dist. Court Judge Jim Pringle for guidance regarding when Seven should be euthanized. Cole also will be notified of the impending action.

At this point, only an emergency court order or other court action could delay the process, Muret said.

The case originated in municipal court but was moved to district court when Cole appealed Judge Tom Herlocker’s order to have the dog euthanized.

Seven is currently being kept at a home in rural Cowley County.
