County, Family Near Agreement on Gate and Fence Concerns

Cowley County commissioners and a local family – who built a gate and fence near the roadway in a rural part of the county – are close to a resolution to concerns about the structure.

County administrator Lucas Goff told NewsCow this week that attorneys are working out the final details of an agreement. The security gate at the home, 14876 318th Drive, will be allowed to remain in its present location.

About 25-feet of fencing, though, on the north side of the gate and extending to a nearby bridge on Cowley 1, will be removed and, if replaced, located away from the county’s easement. Goff said a survey will be conducted to establish the exact location of the easement.

Commissioners recently visited the location of the gate and voted on a proposed solution.

The county had previously contacted the Istas family with concerns about the gate and fence’s proximity to the roadway. Portions of the structure were within the county’s roadway easement and county engineering officials had concerns about liability, should an accident occur.

The Istases constructed the gate and fence to improve security and monitor access to their home and property.

The agreement being discussed is very similar to a solution offered by an attorney for the Istas family.
