UPDATE: AC Juvenile Fled Home, Called 911 After Parent Fired Rifle; No Evidence For Trespassing Claim

Updated: 1:19 p.m.

New information from the Cowley County Sheriff’s Office Saturday afternoon sheds new light on a shooting incident east of Ark City Friday.

Undersheriff Christina McDonald told KSOK-NewsCow a 16-year-old juvenile called authorities just before 3 a.m. after a man fired a rifle inside the home and again outside.

The juvenile fled the home at 11 Autumn Road in the Lake Wynds neighborhood east of Ark City and called 911.

McDonald said the front door window was shot out and later, damage was located on a tree in front of the home.

The juvenile was not threatened but was in the house when shots were fired. No persons were harmed.

Sheriff deputies arrived on scene and made contact with 37-year-old Darin Jake Pinion, who told authorities he was trying to scare someone off his property and was giving warning shots.

McDonald said no evidence was found to back up those claims.

McDonald said deputies surveyed the area and no trespasser was found. Deputies found no tracks and McDonald said a canvass of the neighborhood was completed and no one reported seeing anyone in the area.

McDonald said the juvenile’s other parent, who was at work at the time, was called.

A toxicology report is pending on Pinion, who as of 6 p.m. Friday, remains in the Cowley County Jail on a $10,000 bond.

Pinion was cited in connection with an accident involving his pickup truck and a train in October 2018.

Pinion was cited for failure to obey a railroad crossing signal, failure of duty to report an accident or render aid, no proof of insurance and reckless driving.

Pinion allegedly fled the scene on foot, according to the train crew, who had made contact with him before he left.

Police said alcohol was suspected in that incident.
