Robbery charge is dropped in casino case

A felony robbery charge has been dismissed against a Derby man who was accused of stealing $3,000 from a gambler in the First Council Casino parking lot south of Arkansas City last June.

The charge was dismissed Monday in Kay County District Court against Terry Wayne Menefee, who was 27 when the incident occurred.

"The victim was satisfied with having the money he said was stolen from him paid to him by the defendant – and that was done," Tara Portillo, assistant district attorney, said.

Menefee and three others were spotted on a?surveillance video watching a Wichita man gamble at the casino. The man left with his winnings and went out to take a nap in his vehicle in the parking lot.? He did not lock the doors.

Investigators believed Menefee pulled the man out of his vehicle, hit him over the head with a handgun, taking the money and leaving.

"The gun was tested and no forensic evidence was gained from testing the weapon," Portillo said. "None of the victim’s blood was on the gun. No fingerprints were on the gun."
