Judge: Brownell will be prosecuted as juvenile

Austin T. Brownell will be remain charged as a juvenile, but could face an adult sentence if he’s convicted in the summer shooting of Angela Krepps, Cowley County Attorney Chris Smith said.

A judge Wednesday denied Smith’s request to prosecute Brownell as an adult but did approve extended jurisdiction if Brownell is convicted. Under extended jurisdiction, Brownell would be sentenced as both a juvenile and adult.

The adult sentence is stayed unless the offender commits another crime or does not complete sentencing requirements, according to court officials.

Brownell, who was 15 when he is alleged to have shot Krepps at her home near Cambridge, will be arraigned Oct. 9. At that time he will enter a plea of guilty or not guilty to a charge of attempted first-degree murder.
