Jury convicts Montoya of DUI on Tuesday

Ric Montoya was convicted of driving under the influence during a jury trial in Winfield that concluded Tuesday, Cowley County Attorney Chris Smith said.

The DUI was the Winfield man’s fourth and the defendant opted to take this case to trial rather than reach a plea arrangement with prosecutors. He was also found guilty of refusing a preliminary breath test and driving without headlights.

The incident occurred April 29.

Montoya faces up to a year in jail. He will actually receive a Kansas Dept. of Corrections sentence but serve his time in Cowley County.

It’s the second time in just over three years that Montoya faced a Cowley County jury. In the summer of 2006 he was acquitted of charges brought in connection with the death of Winfield’s Donnie Irvin.
