Smith still mulling charges in online sex case

Cowley County prosecutors are reviewing the case of an Ark City man accused of soliciting young teen girls on the Internet and have filed no formal charges so far, county attorney Chris Smith said.

"The case is being reviewed," he said. "What we have right now is a lot of he said, she said. We’re trying to determine what evidence we have to corroborate the claims."

Thomas L. Pennycuff, 25, already has been charged with one count of electronic solicitation of a child in Sedgwick County. He has pleaded not guilty to that charge and had his trial date set for Feb.22, according to Wichita news reports.

Pennycuff was charged in Sedgwick County last month after authorities there say he used the Internet to arrange a meeting with a girl under the age of 16. The girl ended up being a police detective.

Ark City police said Pennycuff solicited at least 13 area girls online. Those are the charges Smith is reviewing for possible prosecution.
