UPDATE: Boy, 14, accuses man of sex crime

A 14-year-old Winfield boy has accused a local college student of sexual assault following an incident at a local residence, police said Tuesday.

Andrew Sykes, 21, was arrested Saturday and faces a single count of aggravated criminal sodomy, a felony. His bond was set at $7,500 and Sykes bonded out within 12 hours of being arrested.

The 14-year-old boy, whose name has not been released, went with his mother to the police station to report an assault had occurred, according to police chief Danny Parker. Sykes and the alleged victim had been at an apartment or house where a group of friends or acquaintances had gathered.

Because of the child’s age, he would be unable to consent to a sexual act with Sykes, Parker said. There is no indication force was involved.

“It wasn’t a welcomed act,” Parker said. “But not forceful either.”

Following an interview with the accuser and other witnesses, Sykes was arrested.

In Kansas, an aggravated criminal sodomy charge can include sexual penetration or oral copulation.

“At that age (alleged victim), you don’t have to say no to indicate you are not consenting,” Parker said.
